Terra Ceia Preservation Overlay District Legal Fund

It has taken three years, but the Development Focus Group has developed a fair and viable Terra Ceia Island Preservation Overlay District document. If we are to preserve our “Olde Florida” character and unique community lifestyle, now is the time to take the final step for us to get this enacted and we need your help!    The overwhelming support expressed by a majority of property owners who responded to the initial survey and again recently by the membership at the July 9th VIA General Membership meeting is evidence you still want this overlay protection for our community.

   The overlay document is completed but there is one more hurdle to overcome. We must address a comment/concern that the Manatee County Attorney has raised before we can go before the County Commission for enactment. The Development Focus Group has secured a legal opinion and has been assured that this issue can be addressed.

   Since this is a legal issue, we will need legal counsel to pursue the matter. Unfortunately, there are no funds available in the treasury to take this next step. We therefore come to you, the membership, and request that you assist us in securing the funding necessary to accomplish the enactment of the Terra Ceia Island Preservation Overlay District.

Why do we need to act now?

   If the Overlay District effort is shelved the accomplishments to date could well be lost.

   The current make-up of the Commission is more likely to approve the overlay now than when we started. Future Commissions may be less likely to approve it.

   The current slow development market is in our favor as no new development is being pursued and the Commissioners can deal with it as a resident’s issue.

   The economy will rebound, developers will want to maximize the density of their developments; and, without optional established guidelines in place, gated communities, street lights, sidewalks and all the other so called “amenities”, which are not what we want on our island, will follow

   There is no question that the Overlay District will protect the living environment and future value on Terra Ceia Island as desired and confirmed by written survey of the overwhelming majority of residents as well as your recent vote of support.
